Football-Data.org - General Terms and Conditions

Football-Data provides a free Football-Data API (with upgrade options) to the world wide development community. Please read these Terms and Conditions carefully.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Our Privacy Policy explains what information we collect, why and how we use it. You can find our Privacy Policy at the bottom at https://www.football-data.org/about.

DEFINITIONS:
A. Service Provider, the company Freitag Web Tec UG, owner of the football-data.org API service
B. Service, the Football-Data API, a RESTful, reliable and free football data API
C. Customer, you, the end-user who uses the Service.

1. ACCEPTING THE TERMS
1.1 By signing-up for the Service, the Customer accepts these General Terms and Conditions in full, without any reservation. Customers who do not accept these General Terms and Conditions should not sign-up or use the API key provided.
1.2 In order to access the Service you may be required to provide certain information (such as a valid e-mail address) as part of the registration process for the Service.
2. USING THE FOOTBALL-DATA API
2.1 In order to use the Football-Data API, Customers must register by completing the registration form. Customers must provide all information that is marked as being required. Incomplete registrations shall not be validated.
2.2 After successfully registering, the Customers will receive their API Key which they can use to access the Football-Data API.
2.3 The API Key applies to a single Application, in its web and/or mobile form and on any platform (i.e. for the web Application: the Subscription applies to a single domain name). The Customer undertakes to refrain from using the Services for another application than the one for which the Subscription has been originally subscribed.
3. FAIR USE POLICY
3.1 Customers who subscribe to the Service must adhere to Service Provider's Fair Usage Policy.
3.2 Service Provider's Fair Usage policy is that Customers should be able to use the Service in an appropriate manner to meet the needs as presented by their Subscription to the Service.
3.3 The Service Provider will monitor the Customer's usage to ensure they are not in breach of the fair usage policy. If a Customer's usage is continually excessive, unfair, affects other Customer's enjoyment of the Seller's Service or is not consistent with the usage we would typically expect on that Customer's current Subscription, the Service Provider will have the right to cancel the service without prior formal notice.
4. SUBSCRIPTIONS & TIERS
4.1 The Football-Data API provides a free and several paid subscription tiers. The fees and features of each tier are indicated on the pricing page that can be found at https://football-data.org/pricing. Features include number of competitions, data access levels and API call limitations.
4.2 The Customer can upgrade or downgrade the subscription at any time by e-mailing billing@football-data.org. There will be no refunds or credits for partial months of paid subscription tiers.
4.3 The Customer can cancel the subscription at any time by e-mailing billing@football-data.org. There will be no refunds or credits for partial month of cancellation.
4.4 The Service Provider may change the fees and payment policies for the Services by notifying the Customer in writing by e-mail at least 30 days before the change takes effect. When effective, the new fees apply upon the renewal of the subscription. Customers who continue to use the Services after the entry into force of the new fees shall be deemed to have accepted them.
4.5 The Service Provider can cancel a Customer's Subscription in writing by sending an email to the Customer with at least a 15 (fifteen) days notice. This cancellation shall be effective at the end of the month during which said notice has ended.
4.6 Subscription cancellation is effective upon expiration of the last Subscription month and causes the automatic deletion of the Customer's Account, along with all corresponding stored and indexed data.
5. PAYMENTS
5.1 The payment of the Subscription fee is carried out by recurring monthly payment from the Customer's credit or debit card. The recurring monthly payment is implemented by the secured payment service provider Stripe. The fee for the Subscription is due and the recurring monthly payment is taken out on the day of the first Subscription, then on the date of each Subscription renewal.
5.2 The Customer guarantees to the Service Provider that they have all the necessary authorizations to use the chosen payment method.
5.3 Customers are hereby informed and expressly agree that any payment delay of all or part of an amount within the framework of their Subscription and these Conditions, at its due term, shall automatically entail, without prejudice to the provisions set out in Article 18 and without prior formal notice:
6. CONFIDENTIALLY
6.1 Developer credentials (such as API keys and passwords) are intended to be used by you and identify your API Client. You will keep your credentials confidential and make reasonable efforts to prevent and discourage other API Clients from using your credentials. Developer credentials may not be stored in code repositories of open source projects.
7. ATTRIBUTION
7.1 You agree to include the following attribution to Football-Data in your app or website: "Football data provided by the Football-Data.org API". This attribution could be published in the footer, about us section or another visible location in your app or website.
8. WARRANTIES AND LIABILITY
8.1 The Service Provider goes to great lengths to ensure the accuracy, correctness and reliability of the Services, but we make no representations or warranties as to the Service's accuracy, correctness or reliability. We do not provide any guarantees regarding the availability of the Service or the accuracy of the data provided under this Service.
8.2 We accept no responsibility for any losses incurred through the use or termination of the Service.
8.3 Under no circumstances will the Service Provider have any liability to the Customer for any loss or damage (whether direct, indirect or consequential and whether in contract or in tort) except as expressly stated in these Conditions.
8.4 The total limit of the Service Provider's liability to the Customer shall under no circumstances exceed the total value of the transaction to date between the Service Provider and the Customer.
9. INTELLECTUAL PROPERTY
9.1 After cancellation of the subscription to the Service, the Customer is not permitted to reference the football data (incl. match fixtures, results, league tables, player/squad data, top scorers) obtained through the Football-Data API on their own site or service.
9.2 All graphics, including team logos and profile photos, are copyrighted by their legal owner. You'll have to obtain consent from the respective owners in order to use them in your application or website. To display these types of content in your app or website you have to arrange the proof of intellectual property yourself.
10. GOVERNING LAW
10.1 The subscription to Services and Conditions shall be governed by the laws of The Netherlands.
11. AMENDMENTS
11.1 Football-Data reserves the right to amend these General Terms and Conditions of Use at any time.
11.2 When effective, the amended General Terms and Conditions of Use apply upon the renewal of the subscription.
11.3 Any Customer that does not agree with the amended General Terms and Conditions must unsubscribe from the Services. Customers who continue to use the Services after the entry into force of the amended General Terms and Conditions shall be deemed to have accepted these amendments.
12. EFFECTIVE DATE
12.1 These Terms and Conditions become effective on June 1st, 2018.
